These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Indigenous Events ("Company," "we," "us," or "our") regarding your use of our wedding planning and event management services.
By engaging our services, accessing our website at indigenousevents.in, or entering into any service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use our services or website. These Terms apply to all users, including but not limited to clients, website visitors, vendors, and partners.
Service Description
Wedding Planning Services
Indigenous Events provides comprehensive wedding planning and event management services, including but not limited to:
- Full-service wedding planning and coordination
- Destination wedding planning in Udaipur and across India
- Venue selection and booking assistance
- Vendor coordination and management
- Cultural and traditional ceremony planning
- Budget planning and cost management
- Timeline development and event coordination
- Day-of wedding coordination and management
- Guest accommodation and transportation coordination
- Custom design and décor services
Service Customization
Our services are customized based on individual client needs, preferences, and budgets. Specific service details, deliverables, timelines, and costs are outlined in individual service agreements executed for each client.
Service Limitations
While we strive to provide comprehensive services, we do not guarantee specific outcomes, vendor availability, weather conditions, or circumstances beyond our reasonable control. Our services are advisory and coordinative in nature.
Client Responsibilities and Obligations
Information Accuracy
- Provide accurate, complete, and timely information
- Update us promptly of any changes to requirements, timelines, or contact information
- Respond to requests for information within agreed timeframes
- Ensure all provided information complies with applicable laws
Decision Making and Approvals
- Make timely decisions on recommendations and proposals
- Provide approvals for vendor selections, contracts, and payments
- Attend scheduled meetings and consultations
- Designate authorized decision-makers if multiple parties are involved
Financial Responsibilities
- Make payments according to agreed schedules
- Pay vendor invoices directly or authorize payments through us
- Maintain adequate insurance coverage for events
- Cover costs for changes, additions, or modifications to original plans
Conduct and Compliance
- Treat our team and vendors with respect and professionalism
- Comply with venue rules, regulations, and requirements
- Obtain necessary permits, licenses, and approvals
- Ensure guest behavior complies with venue and legal requirements
Payment Terms and Conditions
Service Fees
- Service fees are outlined in individual service agreements
- Fees may be structured as fixed amounts, percentages, or hourly rates
- Payment schedules are customized based on service type and duration
- All fees are quoted in Indian Rupees (INR) unless otherwise specified
Payment Schedule
- Initial Deposit: 25-50% of total service fee upon contract signing
- Progress Payments: Scheduled payments based on project milestones
- Final Payment: Due before or on the event date
- Vendor Payments: Separate arrangements as per vendor agreements
Late Payments
- Late payment charges of 2% per month may apply to overdue amounts
- Services may be suspended for payments overdue by more than 15 days
- Collection costs and legal fees may be charged for significantly overdue amounts
Refunds
- Deposits are generally non-refundable after the 7-day cooling-off period
- Refunds for unused services are determined case-by-case
- Vendor payments made on behalf of clients are non-refundable
- Cancellation terms are specified in individual service agreements
Cancellation and Modification Policy
Client Cancellation
- More than 12 months before event: 50% of paid fees refunded
- 6-12 months before event: 25% of paid fees refunded
- 3-6 months before event: 10% of paid fees refunded
- Less than 3 months before event: No refund of service fees
Company Cancellation
We reserve the right to cancel services due to breach of contract, non-payment, or circumstances beyond our control. In such cases, we will provide appropriate notice and refund unused portions of payments.
Event Postponement
- Event postponements are subject to vendor and venue availability
- Additional fees may apply for rebooking and coordination
- Force majeure events are handled according to specific clauses below
Service Modifications
- Changes to scope require written approval and may incur additional fees
- Last-minute changes may not be possible due to vendor constraints
- Additional services are charged according to our current rate schedule
Intellectual Property Rights
Our Intellectual Property
- All planning materials, designs, and concepts remain our property
- Website content, logos, and branding are protected by copyright
- Proprietary planning methods and processes are trade secrets
- Vendor lists and contacts are confidential business information
Client-Provided Content
- You retain ownership of photos, videos, and personal content you provide
- You grant us license to use materials for planning and coordination purposes
- Marketing use of your content requires separate written permission
Photography and Media
- We may photograph events for portfolio and marketing purposes
- Clients will be notified and can opt-out of marketing use
- Professional event photos remain property of the hired photographer
Liability and Insurance
Limitation of Liability
Our liability is limited to the total amount of fees paid for our services. We are not liable for:
- Vendor performance, quality, or delivery issues
- Venue-related problems or restrictions
- Weather conditions or natural disasters
- Guest behavior or accidents
- Indirect, consequential, or punitive damages
- Lost profits or business opportunities
Insurance Requirements
- We maintain professional liability and general liability insurance
- Clients are responsible for event insurance and vendor insurance verification
- Wedding insurance is strongly recommended for all events
Indemnification
Clients agree to indemnify us against claims arising from guest behavior, venue violations, or decisions made against our professional recommendations.
Force Majeure
Neither party shall be liable for delays or failures to perform due to circumstances beyond reasonable control, including:
- Natural disasters, severe weather, or environmental conditions
- Government actions, regulations, or restrictions
- Public health emergencies or pandemics
- Labor strikes or transportation disruptions
- Vendor bankruptcies or sudden unavailability
- Venue closures or cancellations
In force majeure situations, we will work with clients to reschedule or modify events as possible, with costs and responsibilities shared fairly based on circumstances.
Confidentiality
Mutual Confidentiality
- We maintain strict confidentiality of all client information
- Personal details, guest lists, and event specifics are kept private
- Financial information and budgets are treated as confidential
- Family matters and personal preferences are protected
Vendor Information
- Vendor contact lists and pricing information are proprietary
- Negotiated rates and special arrangements are confidential
- Professional relationships are protected business assets
Exceptions
Confidentiality obligations do not apply to information that is publicly available, required by law to be disclosed, or necessary for service delivery with your consent.
Dispute Resolution
Negotiation
Any disputes will first be addressed through good-faith negotiation between the parties. We are committed to resolving issues amicably and professionally.
Mediation
If negotiation fails, disputes will be submitted to mediation with a mutually agreed mediator before proceeding to formal legal action.
Jurisdiction
These Terms are governed by Indian law, and any legal proceedings will be conducted in the courts of Rajasthan, India.
Attorney Fees
In any legal action, the prevailing party may be entitled to recover reasonable attorney fees and costs.
